لازم دیدم مواردی در مورد کارهای انجام شده و دستآوردهای خودم و مهرزاد زارعی رو ذکر کنم. که هیچ ربطی به جریان اسماعیلیونیسم ندارد. متاسفانه بسیار دیدم که مردم از ایشون و هیاتشون بابت این موارد ابراز تشکر‌ میکنند که بسیار متحیر شدم! ۱-ثبت شکایت علیه علی خامنه‌ای، شمخانی، باقری، سلامی، حاجیزاده، ارتش ایران و سپاه. که پس از ۱سال و نیم تلاش فراوان موفق به گرفتن حکم تاریخی و بی سابقه در‌ محکوم کردن این جنایت عمدی و تروریسیتی ‌شدیم. که نه انجمن و نه اسماعیلیون حاضر به شرکت در شکایت نشدند! ۲-شکایت رسمی علیه پلیس فدرال(RCMP) بابت عدم انجام تحقیقات و ثبت پرونده جنایی برای این قتل‌عام. که البته فشار دولت جاستین ترودو جلوی این تحقیقات رو گرفته ۳- جلسه با اقای مارک‌گارنو وزیر وقت برای تصویب قانون که هر دولتی در هر زمانی که‌بروی‌کار بیاید موظف است پرونده پرواز ۷۵۲ را در دستور‌ داشته باشد. و همینطور اختصاص روز ۸ ژانویه برای پرواز ۷۵۲ که البته دولت با زیرکی آنرا به روز سوانح هوایی تغییر داد ۴-شکایت برای تعیین خسارت با استناد به حکم دادگاه عالی که نهایتا منجر به تعیین رقم ۱۰۷ میلیون دلار‌برای ۶نفر شاکی شد. ۵- همکاری با ژوزف‌اکرمی برای ساخت مستند "شکسته در باد" فیلی تاریخی و بینظیر که در برنامه ویژه ای از شبکه تلوزیونی صدای امریکا‌ پخش جهانی شد. ۶-همکاری‌با شبکه سی بی سی کانادا برای ساخت مستند ۲ قسمتی که منجر به دریافت جایزه بهترین مستند سال شد ۷-همکاری با شبکه گلوبال برای ساخت مستند که جایزه ویژه گرفت ۸-شکایت در ونکوور کانادا با همکاری "بنای برث کانادا" برای توقیف رقم قرارداد بازی کانادا و ایران. و همینطور رقم جمع شده از محل فروش بلیطهای بازی که منجر به لغو فوری بازی از طرف فدراسیون فوتبال کانادا شد. ۹-همکاری و جلسات بسیار با حزب مخالف(کانزرواتیو) برای فشار حداکثری بروی دولت جاری. که منجر به قرائت چندین بازخواست از دولت در صحن مجلس شد. ۱۰- شکایت از شرکت هواپیمایی اکراین بابت قصور و بی توجهی به شرایط جنگی و انجام عمل و پرواز پرخطر که منجر به این فاجعه شد. ۱۱-مکاتبه با دانشگاه یورک برای اختصاص یادبود شکیبا در دانشگاه. شکیبا فارغ التحصیل از دانشگاه یورک در رشته مدیریت عمومی بود ۱۲-مذاکره و جلسات با مدیران مدرسه راستین برای نصب یادبود بنام راستین مقدم و پارسا قنچی‌ که در مدرسه مذکور تحصیل میکردند. ۱۳-کاشت و وقف درخت چنار قرمز بصورت ویژه توسط شهردار و وزیر استانی، بنام شکیبا و راستین برای جنایت ۷۵۲ در پارک یادبود مشاهیر . ۱۴-نصب تابلو تبلیعاتی(بیلبورد) برای یادبود شکیبا و راستین و پویا بختیاری توسط دوست عزیزم علی اشتری‌و دوستانشون ۱۵-ثبت لایحه رسمی در‌مجلس کانادا برای ارجاع "تحقیقات" پرونده پرواز ۷۵۲ به شورای امنیت سازمان ملل و روشن شدن حقیقت ماجرای جنایت.با تلاش بهزاد مهرآبادی عزیز ۱۶- تحویل نامه بصورت شخصی و حضوری به اقای شامپین وزیر‌امور خارجه وقت پیرامون قراردادن سپاه پاسداران و وابستگانش در لیست تروریستی به همراه مهرزاد زارعی و محمود زیبایی. که البته با مخالفت اقای اسماعیلیون برای امضا روبرو شد! ۱۷- طراحی و راه اندازی وبسایت ویژه برای راستین و شکیبا www.ps752memorial.com ۱۸- طراحی بنای یادبود توسط دکتر اعتماد، مهندس آرشیتکت از کشور‌اتریش. که البته مکاتبه با شهرداری برای اختصاص زمین و فرماندار استان در‌جریان است. ۱۹-و البته موارد انساندوستانه بسیار‌که مایل به نمایش ان نبوده و نیستم. ۲۰-در ضمن همه کارها با هزینه شخصی انجام شده. چون ما بودجه نیم میلیون دلاری بمانند اقای اسماعیلیون و هیاتشون نداشتیم! ما همچنان برای فشار‌ بر ایران بی وقفه در تلاشیم. *در‌مرحله بعد شکایت جنایی و کیفری ما علیه نامبردگان در شکایت قبلی بزودی در دادگاه ثبت خواهد شد. و حکم محکومیت این جنایتکاران را تحویل پلیس اینترپول میدهیم. *در‌ انتها لازمه از تمامی کسانی که در این مدت همراه بودند تشکر کنم؛ مارک‌آرنود، وینس جنوا، مایکل ماستین، اردشیر زارع زاده، ژوزف‌ و سارا اکرمی، رامین ژوبین، اندی بروک. جان تامپسون، دنیل ایسن، بهزاد مهرآبادی، علی اشتری، شپول عباسی، مایکل پارسا، استیو پلگرینی، نیک، دیوید بوید، نمایندگان و مجمع حزب‌ کانزرواتیو، خبرنگارها و احزاب رسانه، فرح ناصر، شلی، الکس پیرسون، بهرنگ رهبری، رامین حقجو، آندره میلنه، مارک پاویلون، ارغوان شمس آرا، خانم فرنوش، فریبا داوودی، استفان لچه، اشکان یزدچی، کاترین مکدونالد، خانم دریاناز، ایران استار، رفه السعد، و همینطور جلال، محمود زیبایی و حمید نیازی، علی آقاوند، علی گرجی و تشکر ویژه از همراه و همدرد همیشگیم مهرزاد زارعی. و دوستان و همراهان بسیاری که حضور ذهن ندارم. و سپاس از‌مردم عزیزی که بی منت پشتیبانی کردند.

متاسفانه با روی کار آمدن دوباره حزب لیبرال کار برای دادخواهی مقتولین هواپیمای اکراینی تمام شد. چون اینها با تعلل و وقت کشی هدفمند، قبول گزارش دروغ ایران، و انتشار یک گزارش دو پهلو در تایید گزارش ایران و بعد هم که رسما اعلام کردند شلیک ۲ موشک به هواپیما فقط یک اشتباه غیر عمدی بوده. رئیس پلیس هم که بدستور دولت رسما گفت هیچگونه تحقیقات جنایی انجام نمی‌شود.حتی شکایتی به سازمان هواپیمای جهانی هم نشد. متاسفانه هیات انجمن برخی خانواده های مقتولین هواپیمای اکراینی، همچنان به رویه دولت لیبرال امیدوار است. دولتی که کوچکترین حرکتی برای تحت فشار گذاشتن ایران نکرد. خب مماشات و سطحی بینی و نداشتن افراد خبره و دلسوز، نتیجه ای بهتر از این نخواهد داشت. مراودات و مذاکرات سیاسی نیاز به تیم حقوقی و سیاسی دارد. نه مشاوره یک فیلمبردار و دانشجو و هنرمند و پزشک و چندی دگر! این همان آب در هاون کوبیدن است. کلا ۴۳ سال است نابخردان همه‌را از وضع بدتر ترسانده اند و امید دادن به مثبت شدن. مدیریت انجمن مصداق همان مدیران نابلد و ولی خوش صحبت ایران است. همچنان غرش می‌کنند که انگار خبری هم هست! مردم هم دلخوش.. ولی امان که وضع روز بروز بدتر است. راهپیمایی و بیانیه و جلسات بی نتیجه با دولتمردان چه سود؟ تظاهرات و بیانیه ها زمانش ۱ سال پیش بود. تا بازی دولت کانادا بر‌ملا شود. فشار بدولت زمان دیگری داشت. متاسفانه چه زود دیر میشود. وقتی میبینیم که هیچکدام از احزاب حرفی از هواپیما نمی‌زنند آیا نباید پرسید راهپیمایی چرا در خیابان‌های تورنتو بود؟ فقط برای جلب نظر دوربینها؟ آیا نباید بازخواست کرد مسول طرح‌رو که چرا تظاهرات در آن بحبوحه انتخابات در جلوی دفتر ترودو برگزار نشد؟ تا نخست وزیر مجبور به پاسخگویی و قبول مسولیت بشود. خب این پیشنهاد که شده بود، چرا رد شد؟! آیا بهتر نبود ۱ سال پیشتر برای فشار به ترودو برای گذاشتن سپاه در لیست ترور، آن مدیران همراه ما‌ اقلیت میشدند؟ یا درباره مگنتسکی؟ آیا تابحال کسی پرسش کرده چرا آن هیات انجمن نه تنها حمایت و تشویق برای شرکت اعضا در شکایت علیه ایران در‌کانادا را نکرد‌بلکه به مخالفت هم‌پرداخت؟ چرا فقط ۴نفر باید در پرونده حکم شرکت کنند‌و حکم بگیرند؟ چرا وقتی آنقدر در مورد تحقیقات جنایی ایرادات می‌گیرند حاضر نشدند همراه ما اقلیت در شکایت علیه ریس پلیس کانادا شرکت کنند! آیا اگر بجای ۴ نفر ۴۰‌نفر‌در پرونده برنده شده بودند باز کانادا از زیر بار حکم دادگاه شانه خالی میکرد؟ اصلا چرا اعضا این هیات بعد از اینهمه نتیجه نگرفتنها و شکست خوردن‌ها همچنان بکار ادامه میدهند؟ آیا یادآور سیستم حکومتی خاصی نیست؟ دریغ از یک عذرخواهی! یا پرسش و پاسخ. عوام هم که کلا عادت به پرسش و مطالبه گری ندارند. گویی دژمن در کمین ملت غیور نشسته است! راستی دادخواهی چه شد؟

ICHR is calling on the Liberal government and all candidates running in the 2021 Federal Election to commit themselves to fight for justice for PS 752 families and refrain from making empty promises to get a majority in the house. PM Justin Trudeau must act unambiguously to support families of victims as, in the past, he has made promises to do. . 19 Months has passed since the Islamic Regime in Iran, in a clear act of terrorism, with two missiles, shot down Flight PS752 with 176 passengers on board. A deliberate act of terrorism that took 176 innocent lives and today the government of Canada is still playing games with justice instead of pursuing it. The families are wounded, frustrated and tired of waiting for justice. PM Trudeau was finishing up the second week of this campaign that ends on election day on Sept. 20, rolling out promise after promise of what a re-elected Liberal government would possibly do. Merzhad Zarei was there to remind him of another promise, the one he made months after the 2019 election. Zarei’s 18-year-old son Arad was on board the Ukraine International Airlines Flight 752 on January 8th 2020, when it was deliberately shot down minutes after take-off from Tehran’s Airport. As the incumbent Prime Minister turned his head, Merzhad Zarei shouted from behind his mask “You promised!” After the Ontario Supreme Court ruled the downing of PS752 was deliberate and an act of terrorism, in a legal case that Mr Zarei is one of the complainants, the Canadian Forensic Report and PM Trudeau stated it was not intentional, and sided with the criminal government in Iran. Canada stands in solidarity with the PS752 victims’ families, however this government does not take any serious actions in the pursuit of justice. Most of the families who speak up, demand Canada condemn IRGC and the Iranian government officials for killing their loved ones by applying the Magnitsky Act sanctions, listing IRGC as a Terrorist entity, and taking the case to the international Criminal Court and UN Security Council. Canada should boycott and sanction corrupt officials of the Islamic Republic, support the families’ and support the ruling of Ontario Superior Court of Justice. ICHR stands alongside in solidarity with the families of the Flight PS752 victims in continued pursuit of justice, and demands the government of Canada take serious actions to ensure the victims receive the justice they deserve, instead of delaying accountability for this atrocity with political games.

Government of Canada Is Not Pursuing Justice for Victims of Flight PS752 March 31st, 2021 March 31, 2021- Toronto, Canada – ICHR strongly believes that the government of Canada is not taking serious steps in pursuit of justice for the families of the victims of Flight 752 and holding Iranian regime to account. “The Families Of The Victims Demand Justice.” We Firmly Call on the Government of Canada to take serious action to bring justice to the families of the victims and to condemn the Government of Iran in practice, by taking the case to the International Criminal Court of Justice and the UN security council, and to refrain from political games. “The Government of Canada has not taken a firm stand up to this date following the publication of the final report of the Islamic Republic on Flight 752, which is clearly intended to cover up the truth behind the shooting down the airplane and mislead the world.” Said Ardeshir Zarezadeh, ICHR director. “All the remarks of the Ministers of foreign affairs, Mark Garneau, Transport, Omar Alghabra, and the Prime minister Justin Trudeau as well as the reports published by the Canadian government are still asking Iranian regime to be transparent in their reports even though the Iranian regime has already published its final report.” Added; Ardeshir Zarezadeh, ICHR director. As you know on may 20, justice Belobaba from Ontario Superior Court, based on facts and evidence plus Ms. Callamard and Ralph Goodale’s reports, ruled that shoot down PS752 was a premeditated terrorist act. You as a non-governmental organization and an independent agency created by an Act of Parliament must admit the Canadian rules in the Judiciary system. So DO NOT USE HUMAN ERROR AND NON-PREMEDITATIVE.. The forensic report is not true and is not based on fact and evidence. It is built by government pressure and dictating. The report by itself mentioned that it is not official and it can not be used in any court and judiciary systems so it's unacceptable how Canada published it as fact and an official report on the government website!! Where is the detail of the TOR-M1 unit in the forensic report? The forensic team and TSB never had interviews and meeting with that kind of Missile system’s experts like Mr. Mike(Mihajlo) S. Mihajlovic. So Mr. Yaworsky can not tell me I don’t know how That Missile cockpit is a lookalike. it's unacceptable. The name is clear it calls “FORENSIC”, so where are corps details and bodies residue pictures, information and Data’s, where are the DNA’s analysis, where are Toxicological tests result. this Forensic report has Obvious lots of Bridging. As you know I submitted a claim against Iran right about 20days after shoot dawn. It took 8month for This Liberal government to deliver the claim court order to Iran! You know why?! And pushing him to step back. My Second Claim was submitted earlier this week against RCMP Commissioner Brenda Lucki, after consulting with some of the best Canadian Lawyers. How do you give me Justice when the TSB report is published based on nothing unless Iranian Dictates! why you didn’t report that site was Bulldozed and you didn’t have anything, any pieces of evidence to analyze.! Then you said Iran was so cooperative? How come?! What cooperation Iran did exactly? You and Parliament published a very harsh statement regards the Belarus matter in 24 hours!, but nothing regards PS752. We are not Dumb, just be aware of that! It is clear that Canada is not satisfied with Iran’s explanation to date, and we remain committed in our pursuit of answers. Iran’s Final report, which cited missile damage to PS752 as the primary cause of its downing, with human error presented as a contributing factor, does not provide answers. It details what happened, but does not address why it happened. In order to hold Iran accountable and seek justice for the victims and their families, a more complete analysis of the causes and contributing factors that led to the downing of PS752 was undertaken by Canada’s Forensic Examination and Assessment Team, which has been collecting, organizing, analyzing, and challenging all available sources of information related to the PS752 disaster. The Team has been provided the details you referred to in your correspondence, and has closely examined the decisions and omissions made by the Iranian authorities that led to the downing of PS752, as well as Iran’s final report. As you may be aware, the Team released its report on June 24, 2021. The report contains a series of facts that highlight how Iranian civilian and military authorities, through their decisions, actions, and omissions, played a significant role in the downing of Flight PS752. The report clearly demonstrates that, although human error did play a key role in the incident, senior regime officials made decisions that directly led to this tragedy. However, Canada found no evidence that the downing was premeditated. Massive failures in communication between the unit and the command and control are at the heart of this tragedy. The report also emphasizes Iran’s troubling lack of transparency. Indeed, its official account of events is dishonest, misleading, and superficial. It deliberately ignores key factors and does not provide answers as to why Iran did not put measures in place to prevent this tragedy. In closing, please be assured that this issue remains one of the department’s top priorities. We will continue this work, even during these challenging times, until our questions have been answered. هفته ای که گذشت در مورد کارزار انتخاباتی احزاب مختلف کانادا، کارشناسان به چند مورد بسیار مشخص اشاره داشتند: - جاستین ترودو که در سخنرانی های کمپینهای انتخاباتی اش مدام از پاسپورت واکسینال دم میزند و هم او که در دوران «شو پادمی» از داخل دفترش بیرون نمی آمد، اکنون تنها و تنها رئیس احزاب کانادایی مطرح در رقابت انتخاباتی است که تقریبا بدون ملاحظات موارد ایمنی و فاصله گذاری اجتماعی مشغول کمپین انتخاباتی است! - وقتی از او سوال میشود، دقیقا منظورتان از کلید زدن انتخابات زود رس در چنین موقعی ( که به قول متخصصان خودتان پیک چهارم و کرونای دلتا و لاندا و ال و بل دم در ایستاده است) چه بود، به جای پاسخگویی صریح و شفاف و احترام به شعور و هوش مخاطبی که رأی خواهد داد، آسمان را به ریسمان میبافد و در جواب چنین پاسخی که باید میگفت «اکنون که به مدد پاندمی به اندازه کافی پول بی پشتوانه پخش کرده ام و مردم ساده دل از کار من راضی اند و بهترین زمان برای شکار رأی هایشان است و میتوانم دولتم را از دولت شل حداقلی اکنون با ارتقا چند کرسی قوی تر کنم» مشغول مهمل بافتن است و با پاسخ های صد من یک غاز به فهم شعور مخاطب می تازد ! - در حالیکه کانزرواتیوها مستقیما و شفاف شلیک به هواپیمای اکراینی را کاملا یک عمل برنامه ریزی شده و تروریستی می‌دانند، ترودو و دولتش یک ماه بعد دست در دست جواد ظریف به خنده و شادی جلسه برگذار‌می‌کنند و سپس آن شلیک شیطانی را خطای اپراتور نامیدند و طی نامه رسمی از ایران خواستند که عذرخواهی کند و خسارت مکفی را پرداخت کند! در حالیکه ارین اتول رهبر حزب کانزرواتیو به صراحت در پاسخ به سوال خبرنگاران و کارشناسان، بارها گفته است که بر خلاف اندرو شیر، رهبر سابق کانزرواتیوها، او به حق انتخاب خانمها احترام میگذارد و سقط جنین را یک حق برای بانوان میداند، به دروغ در مصاحبه ای گفته است که ارین اتول هنوز درنیافته است که حق سقط جنین یک انتخاب منحصرا مربوط به زنان است … در این میان فقط کافیست به تورم و قدرت خرید مردم طی شش سال گذشته مروری کنیم..! اینها اندک افتضاحات این رهبر مردم فریب حزب لیبرال کانادا بود… مطمعن باشید در روزها و ماه ها و سالهای اینده اخبار شرماورتری با روبان جیغ تر تقدیم خاطره جمعی و تاریخ خواهد کرد …

MOGHADDAM ET AL. COMPLAINT AGAINST COMMISSIONER BRENDA LUCKI 1. Whereby, the following are the complainants herein (collectively, “the complainants”): Complainant 1: Shahin MOGHADDAM, citizen of Canada, personally and on behalf of the Estate of his wife, Shakiba FEGHAHATI, deceased or as Personal Representative of his wife, Shakiba FEGHAHATI deceased; AND on behalf of the Estate of his son, Rosstin MOGHADDAM deceased or as Personal Representative of his son Rosstin MOGHADDAM deceased; Complainant 2: Mehrzad ZAREI, citizen of Canada, personally and on behalf of the Estate of his son, Arad ZAREI deceased or as Personal Representative of his son, Arad ZAREI deceased; 2. Whereby, the above-named deceased family members were Canadian citizens; 3. Whereby, the complainants were established to be the legitimate legal representatives of their above-named family members in Zarei v Iran, 2021 ONSC 3377 (CanLII), hereafter Zarei v. Whereby their above-mentioned family members were victims of numerous crimes, including but not limited to, a terrorist act, conspiracy to commit murder, offence involving an explosive or other lethal device, and obstruction of justice, as a result of missiles shot against them while they were passengers of a civilian airliner on January 8, 2020; 5. Whereby the perpetrator publicly admitted to the actus reus, ie the act itself, and were found liable in Zarei v. Iran, the admitted perpetrator being the organization called the Islamic Revolutionary Guard Corps (“IRGC”), led by Ali KHAMENEI, the Supreme Leader of Iran, and senior commanders, Mohammad BAGHERI also known as Mohammad-Hossein AFSHORDI, Hossein SALAMI, Seyyed Abdolrahim MOUSAVI, and Amir Ali HAJIZADEH; 6. Whereby the perpetrator only denied the mens rea, or intention behind the act, claiming the act to have been a human error. 7. Whereby the obstruction of justice by the destruction of evidence by the IRGC has been widely reported, including by the government of Canada, government of Ukraine, and numerous North American reporters who witnessed the site of the plane’s wreckage; 8. Whereby the above-named complainants retained expert evidence and submitted a claim in the Ontario Superior Court (Zarei v. Iran). 9. The experts found that the acts of the accused could not have been accidental, and were intentional. 10. The judge of the Ontario Superior Court, Justice Edward Belobaba, upon reviewing the expert evidence, found that the acts of the accused were, on a balance of probabilities, intentional, and constituted acts of terrorism under Section 83.01(1)(a) of the Criminal Code R.S.C. 1970, c. C-34, as amended. SUBECT MATTER OF THE COMPLAINT 11. Whereby, the complainants were provided with a letter from the Commissioner of the RCMP, Brenda Lucki (“the Commissioner”), by email, on or about July 7, 2021, stating that the Commissioner would not open a criminal investigation against the perpetrators; (Appendix A) 12. The statements of the letter of July 7, 2021, in their entirety are the subject matter of this complaint, including that: A question was also raised on whether the decision to not commence or lead a domestic criminal investigation in Canada was an RCMP decision. It is indeed our responsibility to make these decisions, though we consult with legal counsel and other advisors on the potential viability of obtaining physical evidence, access to witnesses and consider related issues. In this case, it was the RCMP that decided Ukraine was the most competent authority to lead a criminal investigation into the downing. This is because Ukraine had greater rights to access the crash site, to the wreckage, and to witnesses and victims in other countries. FACTUAL AND LEGAL FOUNDATION OF THE COMPLAINT 13. The following facts are undisputed and reported widely by credible media sources. They are accepted as credible and summarized in Zarei v. Iran as follows: [9] The actual events of January 8, 2020 are not in dispute. The grim chronology, as set out in numerous international reports and media investigations, can be summarized as follows. [10] Ukraine International Airlines Flight PS 752 (a Boeing 737-800) was shot down by two Islamic Revolutionary Guard Corps (“IRGC”) Tor M-1 missiles shortly after departing Tehran for Kiev. The first missile hit at 6:15 a.m., the second about 30 seconds later. Engulfed in flames, Flight 752 turned to return to the airport and continued flying for another four minutes. Then it crashed. All 167 passengers (55 Canadian citizens, 30 permanent residents and 53 others on their way to Canada) and 9 crew were killed. [11] After several days, the IRGC publicly admitted responsibility for the crash, blaming human error. The commander of the IRGC Aerospace Force said a defense system operator mistook the passenger jet for a cruise missile. Iranian media offered two explanations: that it was a mistake made by a junior IRGC officer operating the missile system or the result of electronic warfare by the U.S. Army that caused the missile system to see the Boeing 737-800 airplane as a U.S. cruise missile. 14. Any criminal investigation, therefore, will be necessarily narrow, focusing solely on whether the act of violence was intentional or accidental; 15. To determine whether it was intentional or accidental requires expert evidence to assess the plausibility of the accused’s claim that it was an accidental act; 16. The government of Ukraine and Canada, as well as experts retained by the complainants, have agreed that the acts could not have been accidental;1 17. The cited reports, including that of Ukraine, Canada, and the United Nations, point to lack of credibility of Iran’s theory, gaps of information, and destruction of evidence by the IRGC. 18. In reviewing the evidence, the Ontario Superior Court pronounced judgement, concluding that, on a balance of probabilities: [52] I find on a balance of probabilities that the missile attacks on Flight 752 were intentional and directly caused the deaths of all onboard. I further find on a balance of probabilities that, at the time in question, there was no armed conflict in the region. 1 For analysis of the expert reports, as well as the UN and Canada’s dismissal of Iran’s “human error” theory, see paragraphs 40-44 of Zarei v. Iran. For Ukraine’s dismissal of the theory, see: [53] The plaintiffs have established that the shooting down of Flight 752 by the defendants was an act of terrorism and constitutes “terrorist activity” under the SIA, the JVTA and the provisions of the Criminal Code, as discussed above.” 19. It is the duty of members of the RCMP who are peace officers, which includes the Commissioner, as their most basic duty under Section 18 the RCMP Act: (a) to perform all duties that are assigned to peace officers in relation to the preservation of the peace, the prevention of crime and of offences against the laws of Canada and the laws in force in any province in which they may be employed, and the apprehension of criminals and offenders and others who may be lawfully taken into custody (emphasis added); 20. It is the responsibility of every member of the RCMP, including the Commissioner, to respect the rights of all persons, maintain the integrity of the law, law enforcement, and administration of justice; 2 21. The Commissioner, like all members of the RCMP, must also perform its duties promptly, impartially and diligently, in accordance with the law and without abusing her authority.3 Therefore, although the Liberal government of Canada may be unclear as its political intentions with the IRGC, the RCMP must nonetheless fulfill its obligations to be impartial, respect the rights of all persons, and prevent crime and offenses against the laws of Canada. 22. The RCMP’s discretion to decline opening an investigation is not limitless, and the decision must be made rationally on a subjective and objective basis: R v Beaudry, 2007 SCC 5 23. The RCMP’s discretion, as in all administrative decisions, must be exercised reasonably, such that the exercise of its discretion is justifiable, intelligible, and transparent. Canada (MCI) v Vavilov, 2019 SCC 65 at para 65 THE COMPLAINT 24. The complaint is not about national security; 25. In the case at hand, there is a strong public interest to: • deter criminal acts against Canadian citizens, according to the RCMP’s principal duty under Section 18 of the RCMP Act; • secure and preserve evidence of or relating to an offence on behalf of the victims, in collaboration with experts as well as the Ukrainian authorities, and • pursue justice before domestic courts as well as the International Criminal Court; 26. Declining to act on behalf of victims to investigate would thwart these justifiable public interests. 27. And whereas the IRGC has been legislated to be added to Canada’s terrorist list, it is in the public interest to determine the terrorist tendencies of the IRGC; 28. And despite the Commissioner declining to open an investigation, the government of Canada has made an official statement that the RCMP is engaged in criminal investigations against the IRGC to determine if it is a terrorist organization, stating: “our national security and law enforcement agencies are actively engaged in monitoring the activities of these groups, and gathering the evidence required to support a determination of listing as a Terrorist Organization.” https://petitions.ourcommons.ca/en/Petition/Details?Petition=432-00723 29. The contradiction between the statement of the government of Canada that the RCMP is investigating the terrorist tendencies of the IRGC, versus the Commissioner’s statement that it is not, signifies bad faith and/or discrimination, partiality, ultimately unjustifiable use of police discretion, and the Commissioner’s neglect of the RCMP’s duties to prevent unlawful acts of terrorism and violence against Canadian citizens. 30. And the Iran government’s destruction of evidence means Ukraine does not have any particular advantage over Canada; 31. And in any case, that Ukraine and Canada have concurrent jurisdiction to investigate the matter before their domestic courts and at the International Criminal Court; 32. Whereas the Ukrainian Prosecutor General’s Office justifies the opening of a criminal investigation in the following way, directly contradicting the reasoning of the Commissioner in her letter: The investigation of this crime is carried out in absolute conditions of extraterritoriality, without having access to the remnants of the plane wreckage and without the possibility of questioning the witnesses and other persons in the case in the territory of Iran. At the same time, all that did not become a hindrance to the advancement of the investigation toward establishing the objective truth. https://www.gp.gov.ua/ua/b_737 33. And whereas the Ukrainian government does not have jurisdiction to pursue justice for the 55 Canadian nationals; 34. And the Ukraine has only lost 11 citizens compared to the 55 Canadian citizens; 35. And the Ukrainian authorities have solely relied on expert reports to make their findings, and the only issue to be investigated is the intentionality of the act, the identity and act itself having been established; 36. And Canadian and Ukrainian investigators have the ability to share their findings: 37. The RCMP Commissioner has failed to follow her duties under the RCMP Act, and acted unreasonably or partially under political influence; 38. The RCMP Commissioner has compromised the integrity of the Criminal Code, opening it to opportunism and abuse. RESOLUTION SOUGHT 39. As a result of the above, the Complainants seek a Canadian criminal investigation into the downing of Ukraine International Airlines Flight PS752 on January 8, 2020. 40. Furthermore, in order to maintain the public trust and reinforce the high standard of conduct expected of the Commissioner as a member of the Royal Canadian Mounted Police, the Complainants request an investigation into the Conduct of the Commissioner as it relates to her decision on Flight PS752 and all the circumstances surrounding that decision, as provided by the RCMP Act: 40(1) If it appears to a conduct authority in respect of a member that the member has contravened a provision of the Code of Conduct, the conduct authority shall make or cause to be made any investigation that the conduct authority considers necessary to enable the conduct authority to determine whether the member has contravened or is contravening the provision. 41. The Complainants seek to ensure the Commissioner is held responsible and accountable for her decision and for the totality of her conduct in relation to Flight PS752.

Joint Statement of the International Coordination and Response Group for the victims of Flight PS752 03 June 2021 The International Coordination and Response Group for the victims of Flight PS752 today issued the following joint statement: “We, Ministers representing Afghanistan, Canada, Sweden, Ukraine, and the United Kingdom, have taken note of the unique situation in Afghanistan that requires its full attention. As a result, the Coordination Group countries have agreed that while Afghanistan will remain a key partner and continue to play an important role in the group, it will not engage directly in the upcoming negotiations. As it is the Coordination Group’s guiding principle to ensure that all victims of the downing of Ukraine International Airlines Flight 752 (PS752) are treated equally regardless of nationality, Canada, Sweden, Ukraine and the United Kingdom, as well as Afghanistan, will continue to vigorously pursue their efforts to obtain transparency, justice and accountability for all the victims, including Afghan victims and their families. As always, we stand in solidarity with the families and loved ones of the victims of PS752, who continue to grieve their profound loss. They can be assured that the Coordination Group will remain united in their objective to hold the Islamic Republic of Iran accountable for this tragedy.”

https://www.gp.gov.ua/ua/b_737 The Prosecutor General’s Office is conducting the procedural guidance of the pre-trial investigation in the criminal proceedings over the fact of the downing of the Boeing-737 passenger jet Flight PS 752 of the airline company “Ukraine International Airlines” in the sky over Tehran, on 08 January 2020. The pre-trial investigation is carried out by the Main Investigation Department of the Security Service of Ukraine. The preliminary classification of that crime is as follows: wilful killing of two or more persons, committed in a manner endangering the lives of many persons; intentional destruction of property, committed in a generally dangerous manner, which caused the death of people and other serious consequences; violation of the traffic safety rules or the air transport operation rules, which caused the death of people (sub-paragraphs 1, 5 of paragraph 2 of Article 115, paragraph 2 of Article 194, paragraph 3 of Article 276 of the Criminal Code of Ukraine). As a result of that disaster, 176 people, who were the citizens of 6 countries, were killed. Among those killed on board were 11 citizens of Ukraine. The plane was completely destroyed. Ukraine’s jurisdiction to investigate this crime is fully in line with the rules of international law and the rules of national law. Thus, Article 8 of the Criminal Code of Ukraine stipulates that the foreigners who do not reside permanently in Ukraine shall also be liable in Ukraine in the cases as provided for by international treaties or if they have committed any of the grave or particularly grave crimes against the citizens of Ukraine or the interests of Ukraine. The crime committed against the aircraft “Boeing 737” Flight PS 752, registered in Ukraine is exactly such a particularly grave crime, which falls under the international treaty ratified by Ukraine and Iran – items “a”, “b” of Article 1 of the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation of 1971. The investigation of this crime is carried out in absolute conditions of extraterritoriality, without having access to the remnants of the plane wreckage and without the possibility of questioning the witnesses and other persons in the case in the territory of Iran. At the same time, all that did not become a hindrance to the advancement of the investigation toward establishing the objective truth. During the year of the pre-trial investigation, more than two hundred procedural and investigative actions were carried out, 18 requests for international legal assistance were forwarded to other countries, and direct cooperation is being carried out with the competent authorities of Iran and Canada. At this point, the comprehensive criminalistics expert examination is underway to establish the causes and nature of the damage to the aircraft, the amount of material damage and the compliance with the rules of international flights. Last year, two rounds of negotiations were held with the Iranian side, in particular, regarding cooperation within the criminal investigation. At the end of the year, Ukraine received for analysis a draft final report regarding the “UIA” aircraft crash in Tehran, prepared by the Iranian side in accordance with the provisions of the Convention on International Civil Aviation. This is a technical report that can reveal the causes of the aircraft crash. Ukraine has 60 days to submit comments and suggestions to the report, after which Iran will have to finalize it within a month. The report will be published only after its approval by the Council of the International Civil Aviation Organization (ICAO). At present, the Prosecutor General’s Office continues to collect and analyze information concerning the circumstances of that crime. For this purpose, a separate e-mail address PS752@gp.gov.ua was created to receive appeals, messages and documents from the persons who may be aware of additional circumstances of committing that crime and who may be questioned as witnesses. The messages forwarded to this address that do not relate to the PS 752 case will be left unaddressed by the Prosecutor General’s Office. We appeal particularly to the next of kin of the crash victims. You may use this e-mail to provide to the investigation any additional materials that may be available to you, or to express a desire to cooperate with the investigation, including on the basis of confidentiality. Ukraine calls for a criminal investigation The Foreign Minister says “As of now, Ukraine cannot agree with the fact that the plane was shot down due to human error. We are convinced that this issue should be resolved as part of a criminal investigation with the establishment of all the facts,” According to him, only then will it be possible to state definitively that a certain theory was behind the downing of the Ukrainian passenger plane. “Iran should pay the highest price.” Kuleba said today that “the imposition of interpretations is wrong” and that everyone should focus on establishing legal facts. “In any case, the downing of a civilian plane is an illegal act, and Iran will answer for this act in accordance with international law. Iran’s Civil Aviation Organization said on July 11 that the misalignment of the missile guidance system and a decision to fire without authorization had led to the accidental downing of the Ukrainian passenger plane in January. The Ukraine International Airlines (UIA) plane (flight PS752) heading from Tehran to Kyiv crashed shortly after it took off from the Imam Khomeini International Airport at about 06:00 Tehran time (04:30 Kyiv time) on January 8. There were 176 people on board – nine crew members (all Ukrainians) and 167 passengers (citizens of Ukraine, Iran, Canada, Sweden, Afghanistan, Germany, and the UK). They all died. On January 11, Iran admitted that its military had accidentally shot down the Ukrainian passenger jet. Iran’s Islamic Revolutionary Guard Corps (IRGC) accepted full responsibility for the downing of the Ukrainian airliner. It emerged later that the UIA plane had been shot down by two missiles of the Tor-M1 air defense system, which Iran received from Russia.

Reza Banai هنگام کنار زدن ارتجاع و دورویی است! ********************************************************************** رهبران دو حزب لیبرال و نیو دمکرات پیوسته شعارهای ترقی خواهانه می دهند و چهره های واقعی ارتجاعی خودشان را در پشت ادا و اصول های پیشروانه پنهان می کنند. از ادعاهای ضد نژادپرستی و حمایت از حقوق اقلیت ها و دگرباشان گرفته تا پشتیبانی از طبقات محروم و کم درآمد و همچنین کمک به کشورهای فقیر و عقب نگه داشته شده. اما در عمل و یا در قدرت، آن کار دیگر میکنند! مشتی فریبکار و حقه باز و سیاست پیشه هستند. چهره سیاه کرده و نژاد سیاه را به سخره می گیرند، پول مالیات دهنده را صرف عیش و نوش خود می کنند، و با پلید ترین حکومت ها و عواملش نرد عشق می بازند. در جلسات ماتم و اندوه خانوادگان کشته شده های هواپیمای اکراینی اشک تمساح می ریزند و شعار حسابرسی از رژیم جنایتکار جمهوری اسلامی سر می دهند اما تنها چند هفته پس از آن جواد ظریف دروغگو و نوکر سپاهیان جلاد را در بغل می گیرند! آن یکی که سر دسته نیو دمکرات هاست در بغل عوامل آشکار رژیم، دائم جفتک چهار کش انداخته و با آنان در رویای گشودن لانه (سفارت) تروریستی سپاه یک لحظه آرام و قرار ندارد. از بی کسی و ورشکستگی سیاسی آغوش برای فرزندان و پادو های رژیم اسلامی باز کرده و حزب نیو دمکرات را تبدیل به مخفیگاه لابی رژیم پلید اسلامی کرده اند! چرا که شوربختانه اینروزها جایگاه انسانهای شریف و پیشرو مانند جک لیتون و پال دوئر را افرادی چون جاگمیت سینگ اشغال کرده اند! هنگام آنست که مردم و بویژه ایرانیان آگاه دست رد به سینه همه این دغلکاران زده و اجازه ندهند که بیش از این پول و امکانات مالیات دهنده کانادایی در این دوران بسیار دشوار بدست این دو رویان سیاست باز و بی مایه به هرز رود. تا وقتی که این دو حزب به خود نیایند و با انتخاب و گماشتن چهره های کاردان و صادق به مسیر اصلی و اهداف مردمی و پیشرو بازنگردند نباید به آنان اجازه داد تا علاوه برنابودی منابع مادی؛ آمال و آرزوهای ترقی خواهانه مردم کانادا را نیز از بین ببرند!

Those claims allege that the missile defense battery made a 107-degree directional error, that IRGC personnel lost all contact with the command center for several crucial seconds and the operators, “mistook a [130-foot] long commercial passenger jet taking off and ascending from east to west for some sort of threatening aircraft or missile coming in from west to east.” (as quoted in Justice Belobaba’s decision, Zarei v Iran, 2021 ONSC 3377) The UN Special Rapporteur and Canadian Foreign Minister Francois-Philippe Champagne Champagne stated he does not believe Iran’s destruction of PS52 can be blamed on human error and with UN special rapporteur Agnès Callamard who concluded that “inconsistencies in Iran’s official explanation and the reckless nature of the mistakes have led many, including myself, to question whether the downing of Flight PS752 was intentional”. Iran’s Foreign Minister: Intentionality in the downing of 752 “not at all unlikely” In a widely reported audio recording attributed to Iran’s Foreign Minister Mohammad Zarif, Zarif stated that a “deliberate attack” by “infiltrators” was “not at all unlikely”. Oleksiy Danilov, Ukraine’s Secretary of the National Defence and Security Danilov also concluded that “Iran’s refusal to allow international investigators unfettered access to the evidence has convinced him that Iran shot the plane down on purpose”. As reported recently in the Globe and Mail: “Ukraine now says it believes Iran intentionally shot down Flight 752”. Iran’s lead investigator: Iran’s use of commercial air traffic part of a “Human Shield” strategy In July 2020, Canadian press reported a recording from Iran’s then-lead investigator, Hassan Rezaeifer who stated that Iran’s attempt to conceal its ballistic missile strikes against U.S. military forces in Iraq factored into the decision to keep the airspace over Tehran open. Rezaeifer also said that Gen. Amir-Ali Hajizadeh, commander of the IRGC aerospace forces, had orders to fire missiles for “national security considerations.” This admission, that Tehran was using commercial air traffic out of Tehran’s airport as a form of Human Shields, further strengthens similar allegations reported months earlier in a New York Times exposé.

تاريخ شکست نخوردگان چند کلمه به ياد انقلاب ٥٧ ميگويند در سالهاى اخير يک روند "بازبينى" و "بازنگرى" در بين انقلابيون و چپگرايان اپوزيسيون ايران در جريان بوده است. نگاهى به نشريات متعددى که اين طيف بويژه در خارج کشور منتشر ميکند به وجود چيزى از اين دست صحه ميگذارد، هرچند در اينکه "بازبينى" کلمه مناسبى براى توصيف اين روند باشد جاى ترديد جدى هست. در خلوت، وقتى بيان حقيقت کسى را نميرنجاند، ميتوان اين روند را يک روند ندامت توصيف کرد. اما در انظار عموم، جايى که، بويژه اين روزها، نزاکت سياسى (Political Correctness) حکم ميراند، شايد کلمه "نو انديشى" معادل بهترى باشد. يکى از اولين قربانيان اين روند نو انديشى مقوله انقلاب و انقلابيگرى بطور کلى و انقلاب ٥٧ بطور اخص بوده است. هر ماه کوهى مطلب توسط افراد و محافل و جريانات متشکل از بازماندگان و انقلابيون پا به سن گذاشته انقلاب ٥٧ منتشر ميشود. خواندن و تعقيب کردن همه اينها و شريک شدن در مشغله ها و دنياهاى ذهنى نويسندگان آنها هم عبث و هم بسيار دشوار است. اما ديدن روند "نو انديشى" که ذکرش رفت سخت نيست. ميتوان از شيوه "تداعى معانى" که يک ابزار روانشناسهاست سود جست و عکس العمل اين ادبيات را به کلمات کليدى اى، مثلا خود مقوله انقلاب، چک کرد. تصويرى که بدست مى آيد جاى ابهام باقى نميگذارد. انقلاب: افراط، انقلاب: خشونت، انقلاب: استبداد، انقلاب: انهدام. و چرا که نه؟ آخر چه کسى از اين بازماندگان انقلاب ٥٧ هست که بتواند يک لحظه چشمانش را ببندد و به ١٧ سال گذشته فکر کند و خاطرات شيرينى به يادش بيايد؟ ميليونها مردم به زندگى در ارتجاعى ترين و وحشيانه ترين نظام اجتماعى محکوم شدند، جامعه اى مبتنى بر ترس، فقر و دروغ بنا شد که در آن خوشى ممنوع است، زن بودن جرم است، زندگى کردن جزا است و فرار غير ممکن است. يک نسل کامل، شايد نيم بيشتر مردم، اصلا به اين جهنم چشم گشوده اند و جز اين خاطره اى ندارند. و براى بسيارى ديگر، زنده ترين خاطره، ياد چهره هاى فراموش نشدنى انسانهاى پاکى است که بخون کشيده شدند. مگر نه اينست که نقطه آغاز اين کابوس سال ٥٧ بود، سال انقلاب؟ شايد براى بعضى عاقبت نافرجام انقلاب ٥٧ در اين روند "نو انديشى" نقش داشته است. اما نه وسعت اين ندامت و نه تلخى لحن و هيسترى نوانديشان امروز، هيچيک را نميتوان با ناکامى انقلاب ٥٧ توضيح داد. انگار کنار پلى نشسته ايد و بازگشت لشگر شکست خورده اى را ميبينيد. غير قابل انتظار نيست که اين شکست خوردگان را محزون، مبهوت، ساکت و افسرده بيابيد. اما اين جماعت مشت گره کرده اند. وقتى دقيق تر گوش ميکنيد، ميبينيد انگار دارند سرودى را زمزمه ميکنند، آرى، اشتباه نميکنيد، اينها دارند به جنگ ميآيند، به جنگ "سرزمين" و "اردوگاه" و "قلعه" خود، يا بهرحال آنچه خود روزگارى چنين پنداشته و ناميده بودند. اينها دارند براى انتقام از "خود" و "خودى" هاى ديروز برميگردند. براى کسى که از داخل قلعه به بيرون نگاه ميکند، اين حتما منظره هولناکى است. کمتر انقلاب ناکام و جنبش شکست خورده اى چنين تلخ توسط مشتاقان ديروزش بدرقه شده است. انقلاب مشروطيت، جنبش ملى شدن صنعت نفت، دوران حکومت آلنده، انقلاب پرتقال، اعتصاب معدنچيان انگلستان، براى مثال، همواره احترام زيادى نزد پيش کسوتان و شرکت کنندگان خود داشته اند. علت نو انديشى امروز انقلابيون ديروز ايران را بايد جاى ديگرى جستجو کرد. واقعيت اينست که همين سالها، سالهاى پس از انقلاب ٥٧، در سطح جهانى مصادف با رويداد به مراتب مهمترى بود. سقوط بلوک شرق، که اين اواخر ديگر فقط در تبليغات عوام فريب ترين سخنگويان پيمانهاى ورشو و ناتو و هالوترين طرفدارانشان به آن "اردوگاه سوسياليسم" اطلاق ميشد، يک زلزله سياسى و اجتماعى بود که کل دنيا را تکان داد. نفس حذف يک قطب از جهانى دو قطبى، جهانى که همه چيزش، از اقتصاد و توليد تا علم و هنر، براى دهها سال بر محور تقابل اين دو قطب شکل گرفته بود، به اندازه کافى زير و رو کننده بود. اما آنچه در قلمرو افکار و انديشه تعيين کننده بود، اين واقعيت بود که حاکمان جهان و گله وسيع سخنگويان و مبلغين جيره خوارشان در دانشگاه ها و رسانه ها، توانستند سقوط شرق را سقوط کمونيسم و پايان سوسياليسم و مارکسيسم تصوير کنند. کل اين شعبده بازى البته بيش از شش سال بطول نيانجاميد و تمام شواهد امروز حاکى از اينست که اين دوران فريب ديگر به سر رسيده است. اما اين شش سال دنيا را تکان داد. اين پايان سوسياليسم نبود، اما سرنخى بود به اينکه پايان سوسياليسم واقعا چه کابوسى ميتواند باشد و دنيا بدون فراخوان سوسياليسم، بدون اميد سوسياليسم و بدون "خطر" سوسياليسم، به چه منجلابى بدل ميشود. معلوم شد جهان، از حاکم و محکوم، سوسياليسم را با تغيير تداعى ميکند. پايان سوسياليسم را پايان تاريخ خواندند. معلوم شد پايان سوسياليسم پايان توقع برابرى است، پايان آزاد انديشى و ترقى خواهى است، پايان توقع رفاه است، پايان اميد به زندگى بهتر براى بشريت است. پايان سوسياليسم را حاکميت بلامنازع قانون جنگل و اصالت زور در اقتصاد و سياست و فرهنگ معنى کردند. و بلافاصله فاشيسم، راسيسم، مرد سالارى، قوم پرستى، مذهب، جامعه ستيزى و زورگويى از هر منفذ جامعه بيرون زد. موج "نو انديشى" اى که بدنبال اين ماجرا در سطح کل جهان براه افتاد ديدنى بود. در يک مسابقه بين المللى ندامت و خودشيرينى، فضايل ديروز عار شمرده شدند، اصول ديروز نفرين شدند و آرمانهاى ديروز به ريشخند گرفته شدند. حقارت و تسليم بعنوان معنى زندگى به کرسى نشست. در فرهنگ توابيت روشنفکران نظم نوين، هرکس که زندگى بهترى براى همنوعانش ميخواست و معتقد بود که وضع موجود ميتواند و بايد تغيير کند، هرکس که به برابرى انسانها قائل بود و به يک آينده بهتر دعوتشان ميکرد، هرکس که از لزوم تلاش جمعى آدمها براى تاثيرگذارى بر سرنوشت و سهمشان در جهان سخن ميگفت، هرکس که دولت و جامعه را در قبال فرد و آسايش و آزادى او مسئول ميدانست، از هزار و يک تريبون، خوشخيال، قديمى، کم عقل و پا در هوا لقب گرفت. ياس نشان خرد شد، رها کردن آرمان هاى والاى بشرى واقع بينى و درايت خوانده شد. ناگهان معلوم شد که هر ژورناليست تازه استخدام و هر استاديار تازه به کرسى رسيده و هر سرهنگ بازنشسته پاسخ غولهاى فکرى جهان مدرن، از ولتر و روسو تا مارکس و لنين، را دارد و کل معضل آزاديخواهى و برابرى طلبى و تلاشهاى صدها ميليون انسان در چند قرن اخير، جز اتلاف وقت بيحاصلى در مسير رسيدن به عمارت با شکوه "پايان تاريخ" نبوده است و بايد هرچه زودتر به فراموشى سپرده شود. در متن اين فضاى بين المللى است که انقلابيون ديروز به "باز انديشى" پيرامون انقلاب ٥٧ و انقلابيگرى بطور کلى نشسته اند؛ و نتايجى که گرفته اند بيش از آنکه از ناکامى انقلاب ٥٧ ناشى بشود، مديون روند تمسخر ايده آلها و اصول در مقياس بين المللى است که چند سالى به مد روز بدل شد. گفته اند که تاريخ را همواره فاتحين مى نويسند. اما بايد افزود که تاريخى که شکست خوردگان مى نويسند به مراتب دروغين تر و مسموم تر است. چرا که اين دومى جز همان اولى در لباس تعزيه و نوحه و تسليم و خودفريبى نيست. اگر تاريخ داستان تغيير است، آنگاه تاريخ واقعى تاريخ شکست نخوردگان است. تاريخ جنبش و مردمى است که همچنان تغيير ميخواهند و براى تغيير تلاش ميکنند. تاريخ کسانى است که حاضر نيستند ايده آلها و اميدهاى خود براى جامعه بشرى را دفن کنند. تاريخ مردم و جنبشهايى است که در انتخاب اصول و اهداف خويش مخير نيستند و ناگزيرند براى بهبود آنچه هست تلاش کنند. انقلاب ٥٧ در تاريخ فاتحين و شکست خوردگان هر دو، پله اى در عروج اسلام و اسلاميت و مسبب شرايطى است که امروز در ايران حاکم است. در تاريخ واقعى، اما، انقلاب ٥٧ جنبشى براى آزادى و رفاه بود که در هم کوبيده شد. مصائب دوران پس از انقلاب در ايران را بايد بپاى مسببين آن نوشت. مردم حق داشتند رژيم سلطنت و تبعيض و نابرابرى و سرکوب و تحقيرى را که شالوده آن را تشکيل ميداد نخواهند و به اعتراض برخيزند. مردم حق داشتند که آخر قرن بيستم شاه نخواهند، ساواک نخواهند، شکنجه گر و شکنجه گاه نخواهند. مردم حق داشتند در برابر ارتشى که با اولين جلوه هاى اعتراض کشتارشان کرد دست به اسلحه ببرند. انقلاب ٥٧ حرکتى براى آزادى و عدالت و حرمت انسانى بود. جنبش اسلامى و دولت اسلامى نه فقط محصول اين انقلاب نبود، بلکه سلاحى بود که آگاهانه براى سرکوب اين انقلاب، هنگامى که ناتوانى و زوال رژيم شاه ديگر مسجل شده بود، به ميدان آورده شد. برخلاف نظرات رايج، جمهورى اسلامى وجود خود را در درجه اول مديون شبکه مساجد و خيل آخوندهاى جزء نبود. منشاء اين رژيم قدرت مذهب در ميان مردم نبود، قدرت تشيع، بيعلاقگى مردم به مدرنيسم و انزجارشان از فرهنگ غربى، سرعت بيش از حد شهرنشينى و کمبود "تمرين دموکراسى"، و غيره نبود. اين خزعبلات ممکن است بدرد کارير شغلى "شرق شناسان" نيم بند و مفسرين رسانه ها بخورد، اما سرسوزنى به حقيقت ربط ندارد. جريان اسلامى را همان نيروهايى به جلوى صحنه انقلاب ٥٧ کشيدند که تا ديروز زير بغل رژيم شاه را گرفته بودند و ساواکش را تعليم ميدادند. آنها که پتانسيل راديکاليزاسيون و دست چپى از آب در آمدن انقلاب ايران را ميشناختند و از اعتصاب کارگران صنعت نفت درس خود را گرفته بودند. آنها که به يک کمربند سبز در کش و قوسهاى جنگ سرد نياز داشتند. براى "اسلامى" شدن انقلاب ايران پول خرج شد، طرح ريخته شد، جلسه گرفته شد. هزاران نفر، از ديپلوماتها و مستشاران نظامى غربى تا ژورناليستهاى هميشه باشرف دنياى دموکراسى ماهها عرق ريختند تا از يک سنت عقب مانده، حاشيه اى، کپک زده و به انزوا کشيده شده در تاريخ سياسى ايران، يک "رهبرى انقلاب" و يک آلترناتيو حکومتى براى جامعه شهرى و تازه - صنعتى ايران سال ٥٧ بسازند. آقاى خمينى نه از نجف و قم و در راس خيل ملاهاى خر سوار دهات سر راه، بلکه از پاريس آمد و با پرواز انقلاب. انقلاب ٥٧ تجسم اعتراض اصيل مردم محروم ايران بود، اما "انقلاب اسلامى" و رژيم اسلامى محصول جنگ سرد بود، محصول مدرن ترين معادله سياسى جهان آن روز. معماران اين رژيم، استراتژيستها و سياست گذاران قدرتهاى غربى بودند. همانها که امروز از درون لجنزار نسبى گرايى فرهنگى، هيولاى مخلوق خودشان را به عنوان محصول طبيعى "جامعه شرقى و اسلامى" و درخور مردم "جهان اسلام" يکبار ديگر مشروعيت ميبخشند. کل امکانات اقتصادى و سياسى و تبليغاتى غرب براى ماهها قبل و بعد از بهمن ٥٧ براى به کرسى نشاندن اين رژيم و سر پا نگاهداشتن آن بسيج شد. اما اينکه نفس اجراى اين مهندسى اجتماعى در ايران مقدور شد، مديون اوضاع و احوال و نيروهاى سياسى و اجتماعى داخل ايران بود. ماتريال کافى براى اين کار فراهم بود. حرکت اسلامى در همه کشورهاى منطقه وجود داشته است. اما تا رويدادهاى ايران در هيچ مقطعى اين جنبش به يک جريان سياسى قابل اعتنا و يک بازيگر اصلى در صحنه سياسى اين کشورها بدل نشده بود. (ضد) انقلاب اسلامى را نه به نيروى ناچيز حرکت اسلامى، بلکه روى دوش سنتهاى سياسى اصلى اپوزيسيون ايران ساختند. ضد انقلاب اسلامى را روى دوش سنت ملى و باصطلاح ليبرالى جبهه ملى ساختند که از کارگر و کمونيست بيش از هر چيز هراس داشت و تمام عمرش را زير شنل سلطنت و عباى مذهب به جويدن ناخنهايش گذرانده بود. سنتى که در تمام طول تاريخش قادر نشد حتى يک تعرض نيم بند سکولار به مذهب در سياست و فرهنگ در ايران بکند. سنتى که رهبران و شخصيتهايش جزو اولين بيعت کنندگان با جريان اسلامى بودند. ضد انقلاب اسلامى را روى دوش سنت حزب توده ساختند که ضد - آمريکايى گرى بهر قيمت و تقويت اردوگاه بين المللى اش فلسفه وجودى اش را تشکيل ميداد و رژيم اسلامى را، مستقل از اينکه چه به روز مردم و آزادى مياورد، زمين بارورى براى مانور و مانيپولاسيون ميديد. رژيم اسلام را روى دوش سنت منحط ضد - مدرنيست، ضد "غرب زدگى"، بيگانه گريز، گذشته پرست و اسلام زده حاکم بر بخش اعظم جامعه هنرى و روشنفکرى ايران ساختند که محيط اوليه اعتراض جوانان و دانشجويان را شکل ميداد. خمينى پيروز شد، نه به اين خاطر که مردمانى خرافاتى عکس او را در ماه ديده بودند، بلکه به اين خاطر که اپوزيسيون سنتى و اين فرهنگ منحط ملى و عقبگرا، او را، که در واقع وارداتى ترين و دست سازترين شخصيت سياسى تاريخ معاصر ايران بود، "ساخت ايران"، خودى و ضد غربى تشخيص داد و به تمجيدش برخاست. ضد انقلاب اسلامى محصول اين بود که ابتکار عمل در صحنه اعتراضى از دست حرکت مدرنيستى - سوسياليستى کارگران صنعت نفت و صنايع بزرگ، به دست اپوزيسيون سنتى ايران افتاد. اينها بودند که پرسوناژ خمينى و سناريوى انقلاب اسلامى را از غرب تحويل گرفتند و عملا به توده مردم معترض فروختند. عليرغم همه اينها، معرکه گيرى اسلامى تنها توانست وقفه اى در روند انقلاب ٥٧ ايجاد کند. رويدادهاى دوره بلافاصله پس از قيام بهمن نشان داد که ديناميسم انقلاب هنوز برجاست. نشان داد که مردم، هرچه بر زبانشان انداخته شده بود، بهرحال نه براى اسلام بلکه براى آزادى و رفاه اجتماعى به ميدان آمده بودند و هنوز در ميدان مانده بودند. بالاخره، انقلاب ٥٧ مثل اکثر انقلابات، نهايتا نه با فريب و صحنه سازى، بلکه با سرکوبى بسيار خونين به شکست کشيده شد. فاصله ٢٢ بهمن ٥٧ تا ٣٠ خرداد ٦٠ تمام آن فرصتى بود که اسلام و حرکت اسلامى با همه اين سرمايه گذارى ها و تلاشها توانست براى موکلين مستاصل رژيم شاه بخرد. و البته از اين بيشتر نياز نداشتند. در تاريخ واقعى ايران، ٣٠ خرداد به ١٧ شهريور ميچسبد و حلقه بعدى آن است. خمينى، بازرگان، سنجابى، مدنى، فروهر، يزدى، بنى صدر، رجايى و بهشتى، نامهايى هستند که بايد بدنبال محمدرضا پهلوى، آموزگار، شريف امامى، بختيار، اويسى، ازهارى و رحيمى آورده شوند، بعنوان مهره هايى که يکى پس از ديگرى جلوى صحنه ميآيند تا شايد راه انقلاب و اعتراض مردم را سد کنند. رژيم سلطنت و مهره هاى رنگارنگش در مقابل ضربات پى در پى جنبش اعتراضى شکست خوردند. حکومت اسلامى، در عوض، قادر شد فرصت بخرد، نيروى ارتجاع را بازسازى کند و انقلاب مردم را به خونين ترين شکل در هم بکوبد. دستور کار هر دو رژيم يک چيز بود. نيم بيشتر مردم ايران جوان تر از آنند که حتى خاطره گنگى از انقلاب ٥٧ داشته باشند. رابطه اينها با رويدادهاى آن دوره بى شباهت به رابطه نسل انقلابيون ٥٧ با وقايع دوران مصدق و ماجراى ٢٨ مرداد نيست. دورانى سپرى شده و غير قابل لمس که ظاهرا فقط در ذهن نسل معاصر خودش زنده و مهم تلقى ميشود. روايتها از آن دوران زياد و مختلفند، اما بيش از آنکه چيزى راجع به حقيقت تاريخى بگويند، راجع به خود راوى و مکانش در دنياى امروز حکم ميدهند. انسان هميشه از دريچه امروز به گذشته مينگرد و در آن در جستجوى يافتن تائيدى بر اراده و عمل امروز خويش است. نوانديشان ما نيز در نگاه به انقلاب ٥٧، در پى برافراشتن پرچمى در ايران ٧٥ هستند. اما اين پرچم هميشه وجود داشته است. اينکه هر بار چه کسى، با چه تشريفاتى و با زمزمه چه اوراد و آياتى، زير اين پرچم حضور به هم ميرساند مساله اى ثانوى است. منصور حکمت انتشار اول: فصلنامه نقطه، شماره ٤ و ٥، زمستان ٧٤ و بهار ١٣٧٥ اين مقاله مجددا در خرداد ١٣٧٥، ژوئن ١٩٩٦، در نشريه انترناسيونال شماره ٢٩ منتشر شد. به نقل از انترناسيونال هفتگى شماره ٤٠ - ٢١ بهمن ١٣٧٩ - ٩ فوريه ٢٠٠١

آیا راهپیمایی در جهت دادخواهی شلیک به هواپیمای اکراینی لازم و راه گشاست؟ نقد ایرادات و اشکالات هیات انجمن و راهکارها شاهین مقدم - صریحاً، خیر. هدف از راهپیمایی تاثیر بر تصمیم دولت است. راهپیمایی ها و اعتراضات خیابانی زمانش قبل از اعلام موضع رسمی توسط دولت بوده نه بعد آن. - دعوت از سیاسیون بجز نمایش رنگی و سلب مسئولیت ایشان و پروپاگاندای رسانه ای برای اینها هیچ عایدی مثبتی برای خانواده ندارد که هیچ، دولت را هم در موضع بالا دستی قرار میدهد بدون پاسخگو بودن و قبول مسئولیت. - دادخواهی بدون سرنگونی این رژیم جنایتکار امکانپذیر نیست و این شعار انجمن خودش مصداق مذاکره است!! - اگر نگاه کلی بیندازیم، کمپین دادخواهی در جلب افکار عمومی کانادا ضعفهای بسیاری داشته است. مهمترین ضعف آن در این بوده است، که نتوانسته نشان دهد که دولت کانادا چه کارهایی را بایستی میکرده و چه کوتاهی هایی داشته است. در این زمینه بشدت کم کاری شده است. اینکه با نمایندگان احزاب مخالف بحث شود ، کاملا درست است. اما بایستی با سازمان دادن اعتراضات در مقابل دفاتر نخست وزیر و وزارت خارجه و راه و ترابری کانادا به این کم کاری اشاره کرد. مردم در کانادا بایستی متوجه کم کاری دولت شوند و در این زمینه کم کاری شده است از جانب هیات. بدانیم که مردم کانادا در برنامه ها و راهپیمایی ها نیازی به دانستن مسایل و مشکلات ما با ایران ندارند. - البته من در مورد راهپیمایی برای جلب حمایت کانادایی ها موافق هستم. به نظر من خانواده ها با قدرت نمایی در مقابل دولت و اینکه نشان بدهند که میتوانند حداقل افکار عمومی ایرانیان وبعد افکار عمومی کانادایی ها را بدنبال خود بکشانند، درست عمل کرده است. که اگر اینگونه بود چرا بیانیه و سخنرانی ها به فارسی است؟! آیا جامعه هدف ایران است یا مردم کانادا؟. ولی در کل اینکه از این امتیاز در کجا و چگونه استفاده شود نکته اساسی ست. که متاسفانه تا به امروز هیات تمام برگ های خود را سوزانده است! - اشکال کار را من در این می بینم که فشار از پایین را با خواسته های محافظه کارانه به پیش می برند. فشار از پایین بایستی با خواسته های حداکثری باشد. در مذاکره میتوان خواسته ها را پایین و بالا برد، اما وقتی در پایین فشار می آوریم، بایستی فشار حداکثری را از طریق خواست حداکثری بیاوریم. بعنوان مثال وقتی که سرنگونی رژیم را بخواهیم ، ممکن است به انحلال سپاه پاسداران راضی شویم. ولی اگر از اول فقط رفرم در سپاه را مطرح کنیم، همان رفرم را هم نخواهیم گرفت. - دولتمردان باید رودر روی خانواده و در موضع پاسخگویی قرار بگیرند. نه همنشین و همصحبت. و داشتن تریبون. که هیات عملا با ایجاد همنشینی با دولتمردان مسئولیت پذیری و پاسخگویی را از اینان سلب کرده است. - بدانیم که دولت کانادا نسبت به شهروندانش وظایف قانونی و مشخصی دارد که نیازی به تشکر در قبالش نیست. - این اعتراضات خیابانی در زمان مذاکرات باید شکل میگرفته یعنی یکسال پیش که هیات محترم و شخص آقای اسماعیلیون همواره مخالفت کردند. یا زمان رو غیر مناسب تشخیص دادند و یا اعلام کردند این دولت در حال انجام کار درسته و اعتراض جایز نیست. - مسلما در این بن بست بوجود آمده بدلیل سیاستهای پراشتباه وافتضاح انجمن بهترین راه سرپوشانی برگزاری همین تظاهرات و نمایشهاست. و همچنان دریغ از راهکار و سیاستهای درست علمی وعملی. - اکنون خانواده ها نیازمند به داشتن مشاوران مجرب برای خروج از این آوار بر سر فرود آماده هستند. راهکارهای قانونی و حقوقی برای فشار و مقابله با این دولت ظاهرساز و فریبکار. نه با راهپیمایی و دادن امتیازهای بیشتر به دولت و با دعوت از دولتمردان. - راهپیمایی در حال حاضر باید با پشت کرد به سیاسیون و درست در مقابل دفتر نخست وزیر انجام شود. تا ایشان در این گیرودار انتخابات مجبور به پاسخگویی مستقیم و صریح باشد. - تا به کی این هیات بر تصمیمات اشتباه پافشاری دارد. ضعف و عدم تجربه های سیاسی و خود رای بودن همچنان یکه تازی میکند. - این راهپیمایی در نقطه و زمان مناسبی انجام نمیشود. و جز سوزاندن مهره ای دیگر برای خانواده ها نفعی نخواهد داشت؟ - راهپیمایی مونترال چه دستاوردی داشت؟ جز پر کردن برنامه های شبکه های تلوزیونی! - انجمن در این تظاهرات و همینطور راهپیماییهای بعدی باید موضع خود را همان موضع دادگاه انتاریو اعلام کند.. این حداقل یک قدم به جلو است و در ادامه انجمن به افشای برخوردهای کرنش گرانه دولت لیبرال نیز دست بزند که با انتشار گزارش نهایی خود آن شلیک را غیر عمدی خواند. اما برای اینکه بتوان بیشترین نیرو را متحد کرد، میتوان با پیشنهاد بالا جلو رفت که انجمن با بیانیه ای موضع دادگاه انتاریو را موضع خود اعلام کند و از دولت و نمایندگان بخواهد که به تایید موضع دادگاه انتاریو دست بزنند. - انجمن اگر در نفی دولت کانادا نمیخواهد بیانیه بدهد، که به نظر من بسیار اشتباه است چون جامعه کانادایی متوجه کوتاهی های دولت نخواهد شد، حداقل در بیانیه ای با اتکا به حکم دادگاه انتاریو و گزارش خانم اگنس کلامارد خواستار تایید حکم دادگاه انتاریو مبنی بر عمدی بودن شلیک به هواپیما بشود مگر اینکه دولت ایران با ارائه مدارک خلاف انرا ثابت کند. - هیات و شخص آقای اسماعیلیون از ابتدا از شکایت بنده و مهرزاد زارعی حمایت نکردند و حتی به تبلیغات منفی با دادن آدرس اشتباه به خانواده ها روی آوردند. که این شکایت فقط ختم به غرامت میشود. در صورتی که اینطور نبود و همانگونه که مشخص شد ما ابتدا حکم محکومیت قاتلان و عوامل و تایید عمدی و تروریستی بودن شلیک به هواپیمای اکراینی را گرفتیم. - انجمن اشتباه فاحشی کرد که پشت دادگاه انتاریو نیامد. من چندین بار شفاها با خانواده ها صحبت کردم. متاسفانه بدلیل مشاورتهای اشتباه از طرف هیات، خانواده ها فکر می کردند که دادگاه انتاریو فقط مربوط به غرامت خواهی است. در حالیکه من توضیح داده بودم که مرحله اول این دادگاه در مورد عمدی یا غیر عمدی بودن است و اگر حکم به نفع خانواده ها بدهد، این یک پیروزی بزرگ و تاریخی است. دادگاه انتاریو، یک دستاورد بسیار بزرگ بوده است نه تنها برای خانواده ها بلکه برای تمامی دادخواهان و بایستی الان بیشتر مورد استناد قرار بگیرد و دولت کانادا را مورد سوال قرار بدهد که حتی به احکام دادگاه استان انتاریو نیز اهمیت نمیدهد. من کاملا متوجه هستم که حکم دادگاه انتاریو بر اساس "بدون شک و تردید" داده نشده است بلکه براساس "تعادل احتمالات" داده شده است و به همین دلیل در دادگاههای جنایی قابل استنادنیست. اما بدرستی بجای "اشتباه" در برآوردهای هوانوردی ایران، روی عمدی بودن و تروریستی بودن جنایت انگشت گذاشته است. این نکته ای است که در گزارش فورنزیک مفقود است و عملا بدون دلیل نفی شده است. - مورد بعدی در مورد قرار داد هیات با شرکت لابیگر ساسکس است. آیا بهتر نبود بجای قرارداد پرهزینه با شرکت ساسکس برای لابی کردن و مشاوره از شرکتها و انجمنهای قدرتمندتر و مجانی برای مشورت استفاده میشد، مانند گروه C-CAT که حتی نماینده رسمی در دولت دارند؟ - اینها جز مدارا، سفسطه و دادن آدرس اشتباه از طرف هیات به خانواده ها نیست. - این هیات حتی مخالف جبهه گیری علیه سپاه و لیست مگنتسکی بود از ابتدا و آنرا جهت گیری سیاسی میخواند.حتی از نام بردن اسامی چون علی خامنه ای و محکوم کردن آنها سرباز میزد. - نداشتن وکیل رسمی و مشاور سیاسی زبده باعث شده تا هیات در هیچ یک از جلسات خود با دولت، بدون استثنا به کوچکترین نتیجه ای نرسد. این کارها با مشاعرهو اضهار فلاکت پیش نمیرود و نخواهد رفت. مثلا در جلسه پرسش و پاسخ از رییس سازمان امنیت حمل و نقل کانادا (کتی فاکس) در مجلس در حضور نماینگان مجلس و رییس و نماینده نخست وزیر و نماینده سازمان ضد تروریستی کانادا که همگی از سیاستمداران زبده و با تجربه چندین ساله هستند چه کسانی از طرف خانواده ها شرکت دارند؟ با دقت به لیست افرادی که از طرف خانواده ها در جلسات و مذاکرات با دولت شرکت میکنند نگاه کنیم..ایا اینها تمام توانمندی ماست؟ اگر اینست که آخر راه از ابتدا مشخص است. آیا حضور یک وکیل رسمی باتجربه لازم نبود و نیست؟! آیا بهتر نیست از افراد خارج از خانواده ها بعنوان کارگشا و حتی دخیل در امور استفاده کرد؟ در کجا آمده که تصمیم گیرنده با اجرا کننده با کارمند یکی باشد؟! و اما ،اصلا آیا بهتر نبود بجای نام هیات مدیره و رئیس و مرئوس از کمیته های مختلف با استفاده از داوطلبین برای پیشبرد کارها استفاده کرد. که تجربه من چنین نشان میدهد. - استفاده از مشاوران بی تجربه و عملکرد جناحی باعث شده که انجمن تا به امروز کوچکترین دستاوردی را در مورد شلیک به هواپیمای اکراینی نداشته باشه. - عدم وجود وکیل رسمی باعث ایجاد سردرگمی شدید برای خانواده ها بوده است. هنوز بسیار هستند که حتی از حقوق قانونی خود بی اطلاع میباشند. و اصلا در جریان مسایل حقوقی پرونده نیستند. اصلا نمیدانند فرق دادگاه لاهه و دیوان کیفری! - هیات بعد از یکسال و نیم حتی نتوانسته کمکی برای نیازهای مالی بازماندگان از طرف دولت مهیا کند. - بجای برگزاری راهپیمایی بسیار پیشتر لازم بود این هیات گزارشی مبسوط و جامع و کارشناسی در مورد شلیک به هواپیمای اکراینی آماده و در سطح بین المللی منتشر میکرد. که همچنان محقق نشده!! - عدم واکنش مناسب و قاطع توسط هیات در برابر تصمیمات دولت، باعث تحمیل نظرات دولت کانادا بر انجمن بوده و هست و از ابتدا باعث قرار گرفتن انجمن در موضع ضعف بوده است. مثلا چرا در وبسایت رسمی دولت از گزارش نهایی تیم فارنزیک بعنوان سند استفاده شده است. در صورتی که در داخل متن همین گزارش آمده است که ارزش قانونی ندارد و حتی قابل ارایه به مراجع حقوقی نیست. - جناب اسماعیلیون آیا اینکه پرونده به دادگاه بین المللی برود غیر از اینست که فقط برای حل اختلافات مالیست؟ آیا حضور پیام اخوان غیر از حل و فصل مالی قضیه است؟ چرا مساله دادگاه لاهه را طوری در اذهان عموم مطرح میکنید که گویی دادگاه کیفری یا جناییست! خیر این دادگاه فقط برای حل اختلاف مالیست. - لازم دیدم توضیح کوتاهی هم در‌مورد پیام اخوان که دلخوشی هیات انجمن است را بدهم. ایشون در ابتدا موضعش غیرعمدی بودن شلیک به هواپیما بود. و ایشون در جلسه با مارک آرنولد فرمودند که شکایت نکنید به نتیجه ای نمی‌رسید و همه خانواده ها رو بشکست میکشانید. درضمن حتی کشور اکراین درخواست ایشان را برای کمک و شرکت در‌ پرونده را رد کرد. - موضع انجمن و راهکار حقوقی هیات در برابر اعلام رسمی خانم لوکی و وزرای دولت در عدم شروع تحقیقات جنایی در کانادا چیست؟ - دولت کانادا در تاریخ 11 ژوئن اعلام کرد حاضر نشده است که با دولت اوکرایین در تحقیقات جنایی همکاری کند. که معلوم میشود کانادا از همان موقع تصمیمش را گرفته است که تحقیقات جنایی را در مورد این جنایت انجام ندهد، چون میخواسته انرا غیر عمدی و بدون نقشه قبلی اعلام کند. - باید جامعه کانادا بدانند که گزارش کانادا و نحوه عملکردش، موجب تهدیدات خانواده ها شده است و ما دولت کانادا را مسول هر خطری می دانیم که جان خانواده ها را تهدید کند. بایستی این پیام را همه جا منتشر کرد که دولت کانادا با انتشار گزارش خود، غیر مستقیم از دولت جمهوری اسلامی دعوت به ترور و تهدید خانواده ها کرده است، بعنوان تنها دادخواه این پرونده ، چون عملا با غیر عمدی اعلام کردن این جنایت، دست خود را از دادخواهی و روشن شدن حقایق شسته است و خانواده ها را بعنوان تنها دادخواهان در مقابل جمهوری اسلامی رها کرده است. - اکنون که دولت و شخص وزیر خواسته های کانادا را به این شرح رسما منتشر کرده اند عکس العمل حقوقی هیات محترم چیست؟: " در موردPS752 طبق قوانین بین المللی، کانادا و گروهی از کشورها، شرکایش، به روشنی بیان کرده اند که در راستای احقاق حق ایران ملزم به اجرای همه موارد ذیل می باشد: • بیان عذرخواهی عمومی • گزارش کاملی از علل و عواملی که منجر به سقوط شد را ارائه دهد. • بازگرداندن وسایل قربانیان • ایجاد اطمینان از اقدامات انجام شده برای جلوگیری از سقوط های بعدی • ایجاد اطمینان ازتکمیل بررسی جامع سیستم پدافند هوایی ایران و اقدامات محافظتی برای جلوگیری از حملات به هواپیماهای غیرنظامی • اطمینان دادن درتعقیب کیفری شفاف عاملین • پرداخت غرامت برای جبران ضرر و زیانی که در اثر سقوط به وجود آمده است. همچنین وزارت امور خارجه کانادا به همراه سایر کشورهایی که عضو گروه بین المللی پاسخگویی هماهنگ هستند، به دنبال مطالبۀ جبرانِ خسارت از جمهوری اسلامی ایران در مورد سرنگونی پرواز PS752 هواپیمایی بین المللی اوکراین هستند." ( برگرفته از متن اصلی از نامه وزیر) - راهکار حقوقی هیات برای مداخله شورای امنیت سازمان ملل چیست؟ همانگونه که بنده با کمک دوستان با ثبت پتیشن رسمی شماره 3083 به مجلس خواستار ارجاع تحقیقات به شورای امنیت شدیم. البته در اینجا هم هیات با دادن آدرس اشتباه سعی در گمراهی عمومی داشت. مبنی بر اینکه اینرا روسیه و چین "وتو" خواهند کرد. در صورتی که این خواسته فقط برای تحقیقات است نه تصمیمات توسط شورای امنیت و بحث وتو بهیچعنوان مطرح نخواهد بود! - البته اصولا هیات ابتدا به مبارزه و مخالفت با هرگونه فعالیت توسط دیگران و ضعیف نشان دادن آن دست زده. - آیا هیات نباید با به ارج نهادن حکم دادگاه اونتاریو بعنوان بزرگترین دستآورد تا به امروز بپردازد و از آن استفاده کند؟ و البته این سوال مهم همچنان مطرح است که چرا فقط تعداد 4نفر در این شکایت بسیار مهم شرکت داشتند!؟ - حکم دادگاه انتاریو فقط برای غرامت گیری که نبوده. ولی مگر دولت کانادا نگفته است که برای همین مساله مذاکره می کند. پس میتواند به این حکم هم استناد کند.چرا نکرد؟! مگر گزارش فارنزیک کانادا از حکم دادگاه انتاریو بالاتر است که با استناد به مدارک، حکم داده است و اینکه چرا تیم پزشک قانونی که حتی به اندازه یک قاضی اعتبار ندارد، ولی میتواند مورد استناد کانادا برای مذاکراتش قرار بگیرد. لازم به ذکر مجدد است خود گزارش تیم پزشک قانونی کانادا نوشته است که از نظر دادگاه هیچ اعتبار ندارد و نبایستی استفاده شود. یعنی خود گزارش اعتبارش را کمتر از دادگاه انتاریو اعلام کرده است. - آیا هیات نباید با استناد به حکم دادگاه از دولت بخواهد که بازماندگان را veteran و قربانی حمله تروریستی و شهید اعلام کند؟ - آیا هیات برنامه ای برای فشار بر دولت جهت واگذاری زمین و ساخت بنای یادبود برای این قتل عام را دارد؟ - آیا اصلا کسی خبری از برنامه های این گروه دارد؟! کجاست آن برنامه راهبردی و سازوکار مشخصش؟ آیا همه این موارد با راهپیمایی و نمایش، حل و فصل میشود؟ دلیل دعوت مردم و این تئاتر بجز نمایش چیست؟! - با اینکه بزرگترین و تنها دست آورد این جماعت حکم دادگاه اونتاریوست ولی عزیزان تا به امروز تریبونی به بنده و وکیل مربوطه برای صحبت ندادند هیچ، بلکه برخوردها کاملا جهت گیر و قهرآمیز بوده. تا اینجا که در همین راهپیمایی مورد بحث در تاریخ 5آگوست در خواست بنده برای صحبت 3 دقیقه ای توسط اقای اسماعیلیون رد شد!! - خانواده ها بدانند همانطوریکه مردم بومی بدون عوض کردن دولت ، مجبورش کردن که معذرت خواهی کند، این نشان میدهد که چطوری بایستی عمل کرد. دولت کانادا30 سال پیش به منطقه اوکا حمله کرد و ارتش را بسراغشان فرستاد که سرکوبشان کند. اما بومیان با نشان دادن بلاهایی که بر سرشان می رود ، توانستند جامعه کانادا را باخودشان کنند. این همیشه عادت ما ایرانیان بوده است که بجای اتکا و سازمان دادن فشار از پایین، یک جعبه شیرینی در دست بگیریم و برویم مقامات را ببینیم بجای اینکه تشکل درست کنیم و مبارزه کنیم. دوستان، بخشی از مردم در ایران اینجوری بار آمده اند. دستبوسی در بالا ، مذاکره در بالا، بجای اینکه مبارزه در پایین ، مذاکره در بالا. انعکاس این فرهنگ است که انجمن فکر می کند با دستبوسی دولت میتواند انرا به نفع خود تغییر دهد. در صورتیکه همین تجربیات تا کنون نشان داده که این دستبوسی در بالا، مذاکره در بالا راه بجایی نمی برد. بایستی با نقد این سیاست، تشویق کرد که سیاست مبارزه در پایین، مذاکره در بالا را جایگزین روش خود کنند.. - به نظر من بایستی انجمن از بومیان کانادا بیاموزد و سیاست "تمجید در بالا، مذاکره در بالا" را با سیاست" فشار از پایین، مذاکراه در بالا " تعویض کند. در این سیاست ما بایستی با مخالفت علنی با سیاستهای دولت در رابطه با این پرونده، به جامعه کانادا نشان دهیم که ظلمی در حق ما شده است. این را بایستی از مردم بومی بیاموزیم، که فشار از پایین از طریق نشان دادن این مساله است که چگونه دولت کانادا کوتاهی کرده است و با نشان دادن این کوتاهی، حمایت انها را جلب کنیم. - آیا در کانادا کسی میداند که دولت کانادا چگونه با تایید گزارش جمهوری اسلامی و تایید اینکه این جنایت عمدی نیست، چه ظلمی در حق خانواده ها کرده است؟ چرا ما یک تظاهرات در مقابل وزارت خارجه که منتشر کننده این گزارش بوده است، انجام نداده ایم که نشان دهیم کوتاهی دولت کانادا چه بوده است؟ چرا به مشاورینی گوش میدهیم که کارش لابیگری در بالا بوده است. چرا از بومیان کانادا و پیروزیهایشان نمی آموزیم؟ و یا چرا راهپیمایی در مقابل دفتر نخست وزیری برگزار نکردیم ؟ - انجمن از سیاست " تمجید در بالا، مذاکره در بالا" تا کنون در برابر دولت کانادا استفاده کرده است، درصورتیکه این سیاست بایستی به سیاست، " فشار از پایین، مذاکره از بالا تبدیل شود". من حتی تظاهرات در مقابل ایکائو را هم قبول نداشتم. بدلیل اینکه تظاهرات واعتراض بایستی علیه دولت کانادا و در جهت روشنگری مردم کانادا باشد که تا کنون حتی به ایکائو شکایت رسمی نکرده است. متاسفانه انجمن خانواده ها بر زمینه همان فرهنگ متداول در میان ایرانیان که بجای مبارزه در پایین و سازمان دادن مردم، همیشه سعی در تمجید با بالایی ها داشته و اعتقادی به فشار از پایین ندارد، مشاوره هایی را قبول کرده است که بر زمینه این تمجید در بالا، فکر می کند دولت لیبرال دلش به رحم می آید وسیاستهای کلان خود را که همیشه در امتداد سیاستهای دمکراتها در آمریکاست، کنار میگذارد و به خواسته آنها تمکین می کند. در صورتیکه برای تغییر سیاستهای دولت لیبرال بایستی اتکا کنند به آگاه سازی افکار عمومی از کوتاهی های آن وسیاست مماشاتش با جمهوری اسلامی و از طریق اهرمهای این فشار، در بالا برای پیشبرد خواسته مذاکره کنند. به همین دلیل من فکر می کنم بایستی اول خانواده ها در جریان این پروسه بیاموزند که سیاستشان را بایستی تغییر دهند. - اکنون کسی در جامعه کانادا نمی داند که گزارش فورنزیک دولت کانادا، چیزی بیشتر از گزارش ایران نبود و حتی به نفی گزارش UN پرداخته و همینطور در مخالفت با حکم دادگاه انتاریو این گزارش نوشته شده بود که کاملا غیر حرفه ای و سیاسی می باشد. این گزارش فقط در ادامه کنفرانس وین و بعنوان هویجی برای رام کردن جمهوری اسلامی نوشته شده است که نتیجه اش فروختن دادخواهی و خون کانادایی ها برای اهداف سیاسی دولت است. سابقه این کار در جریان قتل زهرا کاظمی نیز بوده است. به همین دلیل مجددا پیشنهاد مشخص من این است که خانواده ها بایستی با اعلام تظاهرات در مقابل دفتر نخست وزیر، از ایشون مطالبات اساسی رو طلب کنند. - فقط در سایه این تغییرات است که انجمن میتواند اعتماد خانواده ها را بدست آورد و نشان دهد که میتواند و قادر است همه جانبه مبارزه برای رسیدن به خواسته های آنها را سازمان دهد. البته این یک پروسه است که طی آن سیاستهای کنونی انجمن اشتباهاتش محرز خواهد شد. اگر این حرکات بتواند اثرات خودش را نشان بدهد، انجمن بطور عملی، متوجه اشتباهات سیاست خود شده و حتی در مشاورین خود تجدید نظر خواهد کرد. - حتی در تظاهرات دیروز پنجم آگوست، مواضع انجمن در تایید احمقانه عملکرد دولت کانادا تا به امروز بود! همه جا انجمن میگوید که اولویتش روشن شدن این جنایت است. انجمن معتقد است این یک جنایت عمدی بوده است و در مواضعش آنرا صریح گفته. بایستی بشدت اعتراض بشود به این روش سازشکارانه انجمن با دولت کانادا. - بایستی توجه کرد. که اکثر خانواده ها فعال سیاسی نبوده اند. مکانیسم فعالیت سیاسی اجتماعی را نمیدانند. هنوز نمیدانند که بایستی در پایین مبارزه کرد و بر پایه بسیج پایین ، در بالا مذاکره کرد. من مطمئنم با توجه به رادیکالیسمی که در میان خانوده هاست، این مشاورتهای غلط منزوی خواهند شد و خانواده ها در تجربه پی به صحت مشاورتهای درست خواهند برد. خانواده ها هنوز راه طولانی در پیش دارند... - متاسفانه مشاورتهای غلطی می دهند که درست نیست. این مشاورین این ایده را رایج کرده اند که اگر از دولت کانادا انتقاد شود، این دولت بر ضد خانواده ها حرکت خواهد کرد. این یک مشاوره بسیار غلط است. یکبار دیگه نگاه کنید به مبارزات مردم بومی کانادا علیه دولت کانادا. تا بحال یکبار هم حاضر نشده اند بیخود تشکر کنند، همیشه بدرستی انتقاد کرده اند و دولت کانادا هم مجبور است هر روز عقب نشینی کند. بایستی با این برداشت مقابله کرد که دولت کانادا را بدون فشار و فقط با تعریف و تمجید ، میتوان وادار به کاری کرد. بایستی با افشای کم کاری آن، با افشای سازش کاریهایش، با افشای اینکه میخواهد با جنایتکاران اسلامی سازش کند و خون کانادایی ها را به حراج بگذارد، افکار عمومی را باخود کنند، آنوقت دولت کانادا مجبور میشود تحت این فشار، دست به کاری بزند نکته دیگر از مشاورت غلط به انجمن این بوده است که گویا نبایستی از دولت کانادا انتقاد کرد، چون برای بردن این شکایت به دادگاه لاهه ما به کمک دولت کانادا نیازمندیم. این کاملا غلط است. هیچ حزب سیاسی بدون فشار از پایین ، حاضر نمیشود به خواست یک عده تن بدهد. بایستی این شیوه برخورد را به نقد کشید.. - در انتها بگویم که بارها بنده به توهین و تقابل با انجمنی محکوم شدم که کوچکترین دستاوردی تا به امروز نداشته. و به باور بسیاری از سیاسیون با گوش و چشم بسته فقط راه میرود. ولی بکجا؟ امیدوارم سرانجام این جماعت ختم به خیر شود. من نیازی به این جماعت ندارم که متهم به موارد برای پست و سمت و مال باشم. حکم محکومیت جنایتکاران رو در دست دارم. و نتایجی رو ثبت کردم در کنار این حکم، بی همتا و غیر قابل درسترس توسط هیات. - در انتها گله ای هم دارم و آن اینکه از هیات خواستم که بمانند مراسم مونترال از تصویر و کردیت شکیبا و راستین برای مقاصد خودشان استفاده نکنند. 174 عزیز دیگر در پرواز بوده اند که میتوانند تصویر یکی از آنها را بر دوش حمل کنند.! و حرمت شکیبا و راستین رو نگه داشته و وارد بازیهایشان نکنند.

Message of solidarity with the families of the victims of downed Flight PS752 We would like to begin by expressing our deepest sympathies with all the families who lost their loved ones in the PS752 horrific tragedy. The depth of your sorrow and the void that has been left in your lives are truly unimaginable. Even the passage of time can hardly begin to heal your pain. We would like to send our greetings to you - for your resilience, for your courage and for your determined fight to unearth the truths of this horrific crime and to bring those behind it to justice - despite the mendacity, the threats, the shameless lies and the obstructions by the Islamic regime of Iran to cover up its bloody tracks and to impede a true, transparent, international investigation into its crime. After three days of lies and denials, claiming that this was just an air accident, the result of a technical fault or an attack by the enemy, when incontrovertible evidence emerged that the plane had been shot down by surface to air missiles fired from Iranian territory, they finally admitted that it was the vicious deed of their armed forces. However, they then tried to blame it on ‘human error’. They said the operator had mistaken a passenger plane for a cruise missile. Such claims were so absurd that even the heads of the Islamic Republic could not openly defend them, and began admitting to the deliberate nature of their crime. Since then, undeniable evidence, the admission by the regime’s own officials, and – crucially - the historic ruling in May 2021 by Ontario’s Superior Court, have left no doubt that this was an intentional act of terrorism, a planned criminal operation, the decision for which was taken at the highest levels of Iran’s Islamic Republic. The downing of passenger Flight PS752 was pure, premeditated murder by a state, of 176 human beings, who posed no threat whatsoever to them. Whatever their ghastly plans and motivations, this was a monstrous crime against humanity for which the Islamic regime of Iran and its murderous leaders must and will be held accountable. Once again we express our solidarity with you the families of the victims of Flight PS752 and greet your resolve and your tireless fight in unearthing the truths of this crime and bringing those responsible to justice. Dear friends and supporters, · On January 8, 2020, Ukrainian passenger Flight PS752 was shot down by at least two IRGC missiles; · All of its crew and passengers, who were mostly Canadian, were killed; · The Islamic government of Iran, after days of denial, accepted responsibility and blamed this attack on human error; · They have refused to cooperate with the investigation and have used delay tactics to cover up facts around this crime; · The questions of why the air spave was open and why this passenger airplane was shot down and who was behind planning and executing this act of terror remain unanswered; · Instead, the Iranian government has constantly threatened the victims’ families and tried to close the investigation by promising them some compensation money, if they don’t follow up on their demand for independent inquiry; · We remember When Malaysia Flight MH17 was shot down in East Ukraine on July 2014, by pro-Russian rebels, the investigation was blocked by Russia; · After, the demand for an independent investigation was taken to the UN security council, resolution 2166 was passed unanimously and the Russian government cooperated; and The investigators were able to discover the details of how the attack was carried out, and who was behind it. As you know, the deadline for signing Petition E-3083 is approaching. I would like to ask you to sign this petition before Tuesday, May 25th. This petition calls upon the government of Canada to take the matter of investigating the shooting down of Flight PS752 to the UN Security Council by soliciting support from friendly countries and to request support for an independent investigation. Thank you all.\ در 8هشتم ژانویه سال 2020 ، هواپیمای مسافربری اوکراینی بشماره PS752 توسط حداقل دو موشک سپاه پاسداران منهدم شد و همه 176 خدمه و مسافران آن که اکثراً ایرانی کانادایی بودند بقتل رسیدند. حکومت اسلامی ، پس از روزها انکار ، مسئولیت را پذیرفت و دلیل این حمله را خطای انسانی دانست. آنها تا به امروز از همکاری با تحقیقات خودداری کرده و از روشهای مختلف برای تأخیرو سرپوش گذاشتن بر حقایق پیرامون این جنایت استفاده کرده اند. و حتی وقاحت را بیشتر کرده و خانواده های قربانیان را به طور مداوم تهدید میکنند و یا سعی کرده با قول پول غرامت ، تحقیقات را مختومه کنند. این سوالات که چرا این هواپیمای مسافربری سرنگون شده، چرا فضای ایران بسته نشده در حالیکه اماده باش نظامی بوده و اینکه چه کسانی در طراحی و اجرای این اقدام تروریستی نقش داشته اند ، بی پاسخ مانده است.. بیاد داریم هنگامی که پرواز شماره 17 مالزی در سال 2014 در اوکراین شرقی توسط شورشیان طرفدار روسیه سرنگون شد ، تحقیقات توسط روسیه مسدود گردید. پس از آن، درخواست تحقیقات مستقل به شورای امنیت سازمان ملل متحد منتقل شد ، قطعنامه 2166 به اتفاق آرا تصویب، و باعث همکاری دولت روسیه شد. در این هنگام بود که متخصصان توانستند جزئیات و چگونگی حمله و ماهیت افراد پشت پرده را كشف كنند.
